Montana Legal Marijuana Sales To Begin January 1

Legal, adult-use marijuana sales will begin New Year’s Day in Montana. After a protracted process, voters are finally getting to have their say when the pot shops open their doors January 1, 2022.

On Jan. 1, 2022, recreational Cannabis will become available for adult purchase in Montana, reports the Montana Free Press.

Any adult age 21 or older can purchase marijuana and marijuana products, starting Saturday. That includes Montana residents, residents of other American states and territories, and international travelers with valid identification. 

Virtually all marijuana transactions have to be in cash — for now, at least — because of continued federal restrictions on banking services for Cannabis companies. Bring your own to avoid paying ATM fees at the pot shops.

Montana marijuana stores have to put your purchases in a plastic, child-proof “exit bag.” On return trips, bring that reusable exit bag with you. Not only will that limit waste, you can avoid paying for a new one. 

Oh, F*ck. Now We Have ‘Green Counties’ and ‘Red Counties’

Montana Initiative 190 passed 56% to 43% back in November 2020, reports KBZK. You might think that settles the damn matter. But that would be an erroneous assumption. It’s never that dadgum simple, don’t you know (insert a big sigh here).

That, therefore, doesn’t mean you’ll be able to just waltz in and purchase weed anywhere in the state, so settle down, Grasshopper.

Those fortunate enough to live in what called “green counties” — where a majority of residents voted in favor of legal pot — will be allowed to have recreational sales. But residents of benighted “red counties,” where voters opted out of legal sales, won’t have any pot shops. But all isn’t lost, if you’re moored in a a red zone. Those counties can still “go green” by holding a vote.

Watch Out For Federal Land, And Other Things You Should Know

While Cannabis will be legal in Montana, it’s still not legal federally. So that means having weed at Glacier National Park and Yellowstone National Park will still not be legally permissible.

Medical marijuana dispensaries licensed on or before November 3, 2020, will be the only shops for the first 18 months. After July 1, 2023, new businesses can apply for permits.

The Montana law allows adults 21 and up to buy up to one ounce of grass with a 20% state sales tax added. Other localities may levy an additional tax.

Montana Cannabis shops can only open from 9 a.m. to 8 p.m. Adults can have 2 mature plants and 2 seedlings at home.

Public consumption of weed can still get you a civil penalty. And driving under the influence of marijuana will still be illegal and expensive.
